General Information

The Plant Pest Control Section certifies Ohio's nursery stock producers and dealers by performing inspections to help ensure their proper labeling, viability and freedom from pests and diseases. These inspections increase the likelihood of consumers receiving pest-free plants and helps prevent the introduction of new pests. The section helps facilitate commerce by assisting shippers of plant based commodities with the various federal and state quarantines that restrict the movement of articles capable of harboring targeted pests. Plant Pest Control provides inspections and phytosanitary certificates for shipments of grain, seed, logs, lumber, greenhouse plants, and other plant based commodities destined for other states or countries.

A nursery is any location where nursery stock is propagated or grown for sale.

Who is a Dealer of Nursery Stock?

A dealer is a person who sells or distributes nursery stock in or from any nursery, store, sales ground, stand, lot, truck, railway car, or other vehicle. This includes any landscaper who sells nursery stock as a part of the installation of such plants. Nurseries are not considered to be dealers and do not need a Dealer of Nursery Stock license.

Collectors are people who collect, for sale, plants from wood lots, fields, forests, or other native habitats.

Certificate of Nursery Inspection

Certificate of Nursery Stock Inspection

  • Anyone who produces, sells or distributes nursery stock is required to have their stock inspected annually and be issued a Certificate of Inspection.
    • Once the certificate application is received an ODA PPC inspector will schedule an appointment and inspect the nursery stock. If the stock passes inspection, the certificate will be issued. If the inspector finds a serious pest or disease the stock may be seized or restricted from sale until the stock is apparently pest-free and re-inspected.
  • The Certificate of Inspection must be posted in an obvious place at the nursery, and an exact copy must be attached to each package, box, bale or vehicle load, or lot sold or delivered which is wholesaled, sold for resale, or distributed for resale nursery stock in Ohio.
  • Certificates expire annually on December 31. Certificate renewal information is sent to nurseries each November.

How to Apply

  • There are two options to apply for a Certificate of Inspection:

Fees

  • For nurseries with woody stock:
    • $100.00 plus $11.00 per acre of intensive production plus $7.00 per acre of non-intensive production, as applicable.
  • For nurseries limited to brambles, herbaceous, perennial, and other nonwoody plants:
    • $100.00 plus $11.00 per acre of production.
  • Additional places where the nursery sells or distributes stock:
    • $100.00 per additional sales location

Definitions (ORC 927.51)

Intensive production area: A place where nursery stock is propagated or grown using greenhouses, liner beds, lath beds, or containers.

Non-intensive production area: A place where nursery stock is propagated or grown as field stock.

Nursery stock:

  • Any hardy tree, shrub, plant, or bulb, whether wild or cultivated, except turfgrass, and any cutting, graft, scion, or bud thereof.
  • "Hardy," when applied to plants and bulbs, whether wild or cultivated, means capable of surviving the normal winter temperatures of Ohio

Nursery: any location where nursery stock is propagated or grown for sale.

Fee Exemptions (ORC 927.55)

  • A person who produces for sale either within this state or within any state in which such plants and parts do not require a certificate of inspection as a condition of entry, only nonhardy plants and plant parts, vegetable plants, herbs, or forced floral plants, of whatever nature, while in bloom;

  • A person who conducts the sale of nursery stock as a fund raiser for a nonprofit organization or nonprofit purpose for no more than two days per year, who is not a nurseryman, dealer, or collector, and who makes no more than two thousand dollars in revenue from the sale of nursery stock during a calendar year;

  • Any public or private arboretum operated not for profit, which exchanges inspected nursery stock in limited quantities for experimental or permanent arboretum plantings.

Dealer in Nursery Stock License

  • Any collector or dealer who sells or distributes nursery stock is required to have a Dealer in Nursery Stock license.
  • As part of the license application, each licensee provides an affidavit that the dealer will buy and sell only nursery stock which has been inspected and certified by an official state or federal inspector. This is to prevent the spread of serious plant pests and diseases, as well as invasive species.

How to Apply

  • Dealers and collectors have two options for submitting their application:
  • Licenses expire annually on December 31. License renewal information is sent to licensees each November.

Fees

  • The license fee is $125.00 for each place of business the collector or dealer operates.

Nursery stock:

  • Any hardy tree, shrub, plant, or bulb, whether wild or cultivated, except turfgrass, and any cutting, graft, scion, or bud thereof.

Dealer: any person other than a nurseryman who offers for sale, sells, or distributes nursery stock, either exclusively or in connection with other merchandise, in or from any nursery, store, sales ground, stand, lot, truck, railway car, or other vehicle. "Dealer" includes any landscaper who sells or offers for sale nursery stock as a part of a grounds improvement project that may involve the installation of such plants.

Collector: any person who collects, for sale, plants from wood lots, fields, forests, or other native habitat

Federal Phytosanitary Certificates

Phyto Certificates

  • A federal phytosanitary certificate is an official document for plants or plant parts being exported from the United States. It certifies that the plants or plant products have been officially inspected, are free from quarantine pests, are practically free from other injurious pests, and conform to the current phytosanitary regulations of the importing country. ODA Plant Pest Control inspectors are Authorized Certification Officials (ACOs) who can inspect stock and issue phytosanitary certificates.
  • Some US states may require a State Phytosanitary Certificate for the movement of plants or plant products. If you are unsure if a state phytosanitary certificate is required, contact our office.

How to Apply

Federal phytosanitary certificates must be applied for using the USDA Phytosanitary Certificate Issuance and Tracking (PCIT) system. Once your application has been submitted, an ODA ACO will be assigned and schedule the inspection. PCIT is also used to view the status of your applications, print copies of your applications and final certificates, create templates to simplify the application creation process, and make payment.

Fees

  • Phytosanitary Certificate for licensed dealers or nurseries: $25.00
  • Phytosanitary Certificate for non-licensed dealers or nurseries: $100.00

Compliance Agreements

A compliance agreement is a written agreement with ODA that may lessen the number of physical inspections required prior to shipment. An establishment can enter into an agreement which specifies the terms of how regulated articles are to be moved and processed. Terms that are commonly specified in the agreement include the maintenance of records, pest management practices, prenotification requirements, and training of employees. These agreements are commonly used when regulated articles are frequently shipped into or through an interstate quarantine area.
